By accessing or using the website at asphaltpavingtracy.com, or by requesting, scheduling, or receiving any services from Frontier Tracy Asphalt Paving ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.
We may update these Terms and Conditions at any time. Your continued use of our website or services after any changes constitutes your acceptance of the revised terms.
Frontier Tracy Asphalt Paving provides asphalt paving and related services, including but not limited to asphalt sealcoating, driveway paving, parking lot paving, parking lot striping, pothole repair, crack sealing, asphalt resurfacing, asphalt milling, grading and excavation, drainage solutions, concrete curbing, and speed bump installation.
Services are provided in Tracy, CA and surrounding communities within our service area. We reserve the right to decline service for any project outside our current service area or that we determine is outside our scope of expertise.
All services are subject to a written scope of work and estimate agreed upon by both parties before work begins.
Estimates provided by Frontier Tracy Asphalt Paving are based on information available at the time of assessment and are subject to change if conditions differ from what was represented or observed during the estimate. A written estimate is not a binding contract until both parties have signed a separate service agreement.
Prices are subject to change based on fluctuations in material costs, fuel costs, and labor costs. If material costs change significantly between the date of your estimate and the scheduled start date, we will notify you and provide a revised estimate before proceeding.
Free on-site estimates are offered without obligation. Receiving an estimate does not commit you to hiring us, and does not commit us to performing work at the quoted price beyond the terms described in a signed service agreement.
Scheduling is subject to availability and weather conditions. Asphalt and sealcoating work requires dry weather and suitable surface temperatures. We reserve the right to reschedule any job due to weather, equipment issues, or other circumstances beyond our control. We will notify you of any rescheduling as promptly as possible.
If you need to cancel or reschedule a confirmed appointment, please contact us as soon as possible at (209) 699-5534 or quotes@asphaltpavingtracy.com. Cancellations made with less than 24 hours notice for a scheduled project may result in a trip charge or deposit forfeiture, as specified in your service agreement.
You are responsible for ensuring the work area is clear and accessible on the scheduled date, including removing vehicles, equipment, or personal property from the driveway or parking area to be worked on.
Payment terms are specified in the written service agreement for each project. Unless otherwise agreed in writing, payment is due upon completion of the work. We accept payment by methods specified in your service agreement.
For larger projects, we may require a deposit before work begins. Deposit amounts and conditions will be specified in your written service agreement.
Invoices not paid within the timeframe specified in the service agreement may be subject to late fees or interest as permitted by California law. We reserve the right to pursue collection of unpaid balances and to recover reasonable attorney fees and costs if legal action becomes necessary.
Frontier Tracy Asphalt Paving stands behind the quality of our work. Any warranty coverage applicable to your project will be specified in your written service agreement and is limited to the terms described therein.
Warranty coverage is void if the pavement surface is subjected to conditions outside normal use, including but not limited to: excessive vehicle weight beyond the surface design load, chemical spills, damage caused by third parties, improper maintenance by the customer, or natural events such as flooding, tree root intrusion, or soil settlement unrelated to our work.
Asphalt is a natural material that is subject to weather-related wear, including cracking from soil movement, UV degradation, and thermal expansion and contraction. Normal wear of this type over time does not constitute a defect in workmanship. We recommend routine maintenance including sealcoating and crack filling to extend surface life.
To the fullest extent permitted by applicable law, Frontier Tracy Asphalt Paving shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from services provided under a single service agreement shall not exceed the total amount paid by you for those services.
We are not responsible for pre-existing conditions, including underground utilities, irrigation systems, or other subsurface features that are not disclosed to us before work begins. It is your responsibility to have underground utilities located and marked before we begin any excavation or grading work. We will use reasonable care, but we cannot be held liable for damage to utilities or subsurface items that were not disclosed and marked.
Our website and any information provided on it are offered "as is" without warranty of any kind. We do not warrant that the website will be available at all times, error-free, or free of viruses or other harmful components. We disclaim all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose, to the maximum extent permitted by law.
Where permits or approvals are required for a project - such as work affecting a public right-of-way or work in a city or county with specific permitting requirements - we will advise you of those requirements during the estimate process. Unless otherwise specified in writing, permit fees are the responsibility of the customer and are separate from our service pricing.
Customers in HOA-governed communities are solely responsible for obtaining any required HOA approvals before work begins. We are not responsible for fines, required modifications, or other consequences arising from work performed without required HOA approval.

If a dispute cannot be resolved informally, both parties agree to attempt good-faith mediation before pursuing formal legal action. Any unresolved disputes shall be subject to binding arbitration in accordance with the rules of a mutually agreed-upon arbitration provider, to the extent permitted by law.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings arising under these terms shall be conducted in the appropriate courts of California.
You may use our website for lawful purposes only. You agree not to use our website in any way that could damage, disable, or impair the site, or interfere with any other party's use of it. You may not attempt to gain unauthorized access to any part of our website or its related systems.
